What Is Happening In New York With Cheating?

If your partner cheats on you, that may not be illegal much longer in the state of New York.

Back in 1907, it became illegal to commit adultery in New York. Currently, it is considered still illegal to cheat on your spouse so if you do, you could face a misdemeanor charge.

The 1907 cheating ban has been defined as when a person

“engages in sexual intercourse with another person at a time when he has a living spouse, or the other person has a living spouse.”

North Shore Assemblyman Charles "Chuck" Lavine was the one to introduce this new bill because he felt as though the law is not only "archaic," but it is rarely enforced.

"In virtually every one of those cases, there was some other crime involved, and the prosecuting attorney added adultery as just one of many crimes committed."

It seems like a lot of his fellow politicians agree because the bill earned strong bipartisan support and passed on a vote of 137-10 in Assembly.

Should Adultery Be Legal In Michigan?

As of now, according to Michigan Legislature 750.30, it is illegal to commit adultery.

"750.30 Adultery; punishment.Sec. 30. Punishment—Any person who shall commit adultery shall be guilty of a felony; and when the crime is committed between a married woman and a man who is unmarried, the man shall be guilty of adultery, and liable to the same punishment."

If you cheated on your spouse, you would be guilty of a felony, which is a much higher offense than in New York.
